These Terms of Use ("Terms") govern your access to and use of the website sleepkit.co and the purchase and use of products offered under the SleepKit brand (collectively, the "Services").
By accessing or using the website or purchasing products through it, you agree to these Terms. If you do not agree with these Terms, please do not use the Services.
These Terms should be read together with our Privacy Policy, Cookie Policy, and any Return, Shipping, or other policies made available on the website.
If you are a consumer, nothing in these Terms is intended to exclude, restrict, or waive any rights that cannot lawfully be excluded or restricted under applicable Spanish or European Union consumer protection law.
2. Our Services
SleepKit provides sleep-related and general wellness products, together with educational information intended to support healthier sleep habits and routines.
The information available through SleepKit is provided for general informational and wellness purposes only.
SleepKit does not provide medical advice, diagnosis, or treatment. Our website, content, recommendations, routines, and products are not intended to replace advice from a doctor or other qualified healthcare professional.
You should seek appropriate professional medical advice if you have questions or concerns regarding your health, a medical condition, medication, supplements, sleep disorders, or the suitability of a particular product for you.
Individual experiences and results may vary. SleepKit does not guarantee any particular sleep, health, wellness, or other outcome.
3. Intellectual Property Rights

6. Products and Product Information
SleepKit offers physical consumer products related to sleep and general wellness.
We aim to present product descriptions, photographs, characteristics, ingredients or materials where applicable, instructions, prices, and availability as accurately as reasonably possible.
However, website information may occasionally contain typographical errors, inaccuracies, omissions, or outdated information. Where permitted by law, we may correct such errors and update product information.
Product images are illustrative. Minor differences in colour, appearance, packaging, or presentation may occur depending on the device used to view the website, manufacturing changes, or product updates.
Availability is not guaranteed until an order has been accepted.
Products must be used in accordance with the instructions, warnings, intended purpose, and other information supplied with the relevant product.
7. Purchases and Payment
Prices and payment information applicable to an order will be displayed during the purchasing process.
Unless otherwise clearly stated, payments are made in euros (EUR).
Available payment methods are those displayed during checkout and may change from time to time.
You agree to provide current, complete, and accurate purchase and payment information.
Where applicable, taxes, shipping costs, and other charges will be disclosed before the order is completed.
We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of suspected fraud, payment failure, obvious pricing or product information errors, lack of availability, or other legitimate reasons, subject to applicable consumer law.
SleepKit does not currently operate a recurring subscription model unless a particular offer expressly states otherwise.
8. Shipping and Delivery
Available delivery options, estimated delivery periods, and applicable shipping charges will be displayed during the ordering process or otherwise communicated before purchase.
Delivery estimates are estimates unless expressly stated otherwise.
We will fulfil orders in accordance with applicable consumer law and the shipping terms communicated at the time of purchase.
If an order is delayed, lost, damaged in transit, or cannot be delivered, please contact us so that the matter can be handled in accordance with applicable law and the circumstances of the order.
9. Returns, Withdrawal and Refunds
Consumers purchasing online may have a statutory right to withdraw from a purchase within 14 days from delivery without giving a reason, subject to the conditions and exceptions established by applicable Spanish and European Union consumer law.
To exercise a statutory right of withdrawal, the customer must inform SleepKit of the decision to withdraw within the applicable period using a clear statement sent to our contact email or another withdrawal method made available on the website.
Products should be returned in accordance with the return instructions provided by SleepKit.
Where permitted by applicable law, the customer may be responsible for the direct cost of returning goods when this has been properly communicated before purchase.
Hygiene and health-related products
Certain SleepKit products may be personal-use, hygiene-sensitive, health-protection-sensitive, sealed, or consumable products.
Where a product is supplied sealed and is not suitable for return for reasons of health protection or hygiene, the statutory right of withdrawal may cease once the product has been unsealed after delivery, to the extent permitted by applicable law.
This may apply, depending on the nature and packaging of the particular product, to products intended for direct personal or bodily use.
A product will not be treated as exempt from the statutory right of withdrawal merely because SleepKit describes it as a hygiene product. Any exception will apply only where the legal requirements for that exception are satisfied.
Consumable or perishable products may also be subject to statutory exceptions where applicable.
Defective or non-conforming products
The above withdrawal exceptions do not remove statutory rights relating to goods that are defective, damaged, unsafe, incorrect, or otherwise not in conformity with the contract.
Where a product is defective or non-conforming, consumers retain the remedies available to them under applicable Spanish and European Union consumer protection law.
Nothing in this section limits mandatory statutory consumer rights.
10. Wellness and Health Disclaimer
SleepKit products and content are intended to support general wellness and sleep routines.
They are not medicines unless expressly and lawfully identified as such, and they are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Information provided through the website does not establish a doctor-patient or other healthcare professional relationship.
You are responsible for deciding whether a product is appropriate for you and for following all instructions and warnings supplied with it.
If you are pregnant or breastfeeding, have an existing medical condition, have allergies or sensitivities, take medication or supplements, experience persistent sleep problems, or are uncertain whether a product is appropriate for you, seek advice from an appropriately qualified healthcare professional before use where appropriate.
Stop using a product and seek appropriate professional assistance if you experience an unexpected or concerning reaction.
11. Third-Party Websites and Services
The website may contain links to websites, social networks, payment providers, delivery providers, or other services operated by third parties.
These third-party services are not controlled by SleepKit, and their own terms, privacy policies, and practices may apply.
A link to a third-party website does not necessarily constitute an endorsement of all information, products, or services available through that third party.
To the extent permitted by applicable law, SleepKit is not responsible for the independent content or practices of third-party websites.
12. Service Management
We may take reasonable steps to operate, protect, maintain, and improve the website.
This may include correcting errors, performing maintenance, implementing security measures, modifying technical functionality, and restricting activity that threatens the security or integrity of the Services.
13. Modifications and Availability
We may modify, update, suspend, or discontinue parts of the website or change the products offered through it.
We do not guarantee that every product, feature, or part of the website will remain available indefinitely.
Changes will not affect rights already acquired by consumers under completed contracts except where permitted by applicable law.
Temporary interruptions may occur due to maintenance, technical issues, third-party services, circumstances outside our reasonable control, or other operational reasons.
14. Corrections
Information on the website may occasionally contain errors, inaccuracies, or omissions relating to product descriptions, pricing, availability, specifications, or other information.

SleepKit does not guarantee particular wellness, health, or sleep outcomes from the use of its content or products.
Nothing in these Terms excludes any warranty, guarantee, remedy, or other right that cannot legally be excluded under applicable consumer law.
16. Limitation of Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
Subject to that principle, and to the maximum extent permitted by applicable law, SleepKit will not be responsible for indirect or consequential losses that were not reasonably foreseeable at the time the relevant contract was entered into.
Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot legally be limited, defective products where mandatory product-liability rules apply, or any other liability that cannot legally be excluded or restricted.
Nothing in this section affects mandatory rights available to consumers under Spanish or European Union law.
17. Indemnification
To the extent permitted by applicable law, you may be responsible for losses reasonably incurred by SleepKit as a direct result of your unlawful use of the Services, intentional misuse of the website, infringement of third-party rights, or material breach of these Terms.
This provision does not impose liability on consumers beyond what is permitted by applicable law.
18. User Data and Privacy
Our collection and processing of personal data are governed by our Privacy Policy and applicable data protection law.
Information about cookies and similar technologies is provided in our Cookie Policy and through the cookie consent and preference controls available on the website.

20. Governing Law and Consumer Rights
These Terms are governed by the laws of Spain, without prejudice to any mandatory protections that may apply to you under the law of your country of habitual residence.
Where applicable, relevant rules of the European Union and applicable Spanish consumer protection legislation also apply.
For matters for which regional rules are relevant, applicable rules of the Valencian Community may also apply.
Nothing in these Terms deprives a consumer of mandatory protections granted by applicable law.
21. Dispute Resolution
If you have a complaint or dispute concerning SleepKit, a product, an order, or these Terms, please contact us first at sleepkit.team@gmail.com so that we can attempt to resolve the matter informally.
Both parties are encouraged to attempt in good faith to resolve disputes through informal communication before commencing formal proceedings where appropriate.
If a dispute cannot be resolved informally, it may be submitted to the competent courts or to an applicable alternative dispute resolution mechanism in accordance with applicable law.
Any arbitration or alternative dispute resolution mechanism will apply only where validly agreed and legally permitted.
Nothing in these Terms requires a consumer to waive mandatory rights regarding jurisdiction, access to courts, or consumer dispute resolution under Spanish or European Union law.
22. Changes to these Terms
We may update these Terms from time to time to reflect changes to the Services, our products, applicable law, or our business practices.
When we update the Terms, we will revise the "Last updated" date displayed at the top of this page.
Where required by applicable law, or where a change materially affects users' existing rights, we will provide appropriate additional notice.
Changes will not retroactively remove statutory or contractual rights that have already arisen.
